Hotel reservation agreements for PTQV base objects
Definitions
- Application Form
- A standard application form formulated, with an electronic version available, for preparing single standard reservations, cancellation of overnight reservations or accessing other services available on the system rezerwuje.com.
- User
- User is of private status who is aware of the laws and physics of the Civil Code.
- Travel Operator
- Polish Travel Quo Vadis LTD.
REZERVATION
- Reservations are made on rezerwuje.com system only by correctly filling in the application form and sending it with the services chosen.
- In the event of incorrectly completing the application form the user bears all personal responsibility for any action.
- The Operator is not accountable for the unavailability to access the reservation system, for security or any other reason regardless of the contributing Operator.
- The Operator holds the right to refuse access to the rezerwuje.com system for matters of security and any inaccurate irregularities.
- Reservations are approved provided that a charge has been debited from the users valid credit card account or through an approved and validated bank transfer.
FORMS AND CONDITIONS OF PAYMENT
- CREDIT CARD
- In the case of making payment via credit card, the user is obliged to enter and complete all the required credit card details.
- The authorization and charging process is executed on the rezerwuje.com website through a secure encoded 128-bit protocol system that is directly connected to eCard.
- The required amount owing will be charged through the system from the credit card after a 7 day period starting from the initial date of reservation, no later than two working days before the elected date on which the user chooses to take advantage of the reservation service.
- In the case of the lack of funds on the credit card, the amount due towards the payment of the reservation, the reservation becomes ineffective.
- BANK TRANSFER
In the case of a bank transfer payment, the user is required to send the bank transfer confirmation via fax on: (022) 6521461 or (022) 6522113 no later than 3 days prior to the commencement of the service. The recipients' details are as follows::

- VAT Invoice
According to current valid tax laws, Polish Travel Quo Vadis Ltd. issues a VAT invoice for services on a clients claim within 7 days from the date of receiving payment for services requested (credit card charge or bank transfer to our account). If a client doesn't fulfil all requested details reagarding the purchaser or 7 days elapse from receiving the payment, Polish Travel Quo Vadis Ltd. is no longer authorised to issue the invoice.
- Payment of Additional Services
- Any additional services (for example: additional nights, pay television or mini bar) not included in the original reservation request have to be paid by the User on the spot at the hotel.
- The basis currency is the Polish Zloty (PLN). The price presented in EURO and USD is converted at closing rate at the end of each day. Any minor discrepancy in the price is due to the various exchange rates applied by the credit card authorization service center or the bank.
CONFIRMATION
- The system rezerwuje.com includes services available On-Line, confirmed automatically on the basis of the special allotment services reserved for the User, as well as services entailing the Operator's confirmation.
- In the case of a required confirmation by the Operator, the confirmation is sent within a 2 day working period to the e-mail address specified in the reservation form.
- The confirmation includes all essential details about the reservation or the notification of no vacancies at the indicated period.
OPERATORS EXTENDED RESPONSIBILITY
- The Operator is forced to make the best effort in the realization of the service similar in standard to the original as well as in the required time, as specified in the reservation form, only if the realization of the specified service is impossible to be carried out by the Operator
- The Operator can offer an alternative service, similar to that of the original at the specified period completed in the reservation form, if the realization of the initial service is impossible to be carried out for reasons outside the scope of the operator.
- In the case of the User not authorizing an alternative service proposed of similar standard, realization of the service becomes impossible for reasons other than listed in pt.1 or their execution would be linked with the excessive payment according to the Operator charge, then the operator is required to refund the exact amount the User was charged for the service, in reference to pts. 6 & 7
- A received refund of payment to the User exhausts all additional claims of compensation the User may have.
- Refunds, listed in pt.3 will be forwarded to the bank account number specified on the reservation form, on later than one month to the day, on which the User intended to commence using the service.
- The Operator does not take on responsibility for any inconvenience transition caused that may occur at any service providers eg. Hotel costs, shortage of water, heating, electricity and air-conditioning as well as for the inconvenience occurrence caused in a disconnection of services eg. Repairs or maintenance of swimming pools, or other incidences.
- In the case of unforeseeable circumstances, independent of any other actions, life catastrophes, strikes, onset of war or other situations that make it impossible for the realization of the service as agreed, the operator is released from any obligated services.
CANCELLATION
- In the case of canceling a Reservation the following charges are implemented:
- 50 PLN ( approx. 12 Euro) - as long as the cancellation is made 3 days prior to the initial commencement date of the service, when the User is expected to take advantage of the service requested;
- 100% of the total reservation if the cancellation is made following the 3 day period signalizing initial commencement date of the reservation (in the case of an overnight stay - 100% of the cost is charged for the first night);
- 100% of the total reservation cost if the User resigns from using the service without making a formal cancellation, by completing and sending the cancellation form, through the system;
- 100% of the total reservation cost, if the User is a no-show or refuses to utilize all the reserved services requested without making the necessary changes.
- In the case of making a cancellation the full amount owed will be reimbursed via a bank transfer to the bank account specified by the User on the cancellation form.
PERSONAL DATA
- Making a reservation on the Internet website rezerwuje.com the User hereby agrees to have their personal data recorded in the system database of rezerwuje.com as well as the Operator - Polish Travel Quo Vadis Ltd. The recorded data will be processed by rezerwuje.com and the Operator in order to finalize the reservation, allowing the next reservations to be done faster and for marketing purposes (such as sending a newsletter by e-mail or fax, submitting the company name on the clients list of rezerwuje.com) in accordance with the full extent of the Polish Protection of Personal Privacy Law dated 29.08.1997 . Users are entitled to view and make changes to their personal data records.
ACCEPTATION OF RESERVATION CONDITIONS ON THE INTERNET
- Selecting the option "I Agree" indicates, that the Client understands and accepts the all the conditions of the Regulations. If the Client does not accept the conditions of the Regulations the result is a return to the main service page

Service description
- The online hotel reservation system was created and is operated by BOOKING.COM.B.V (trade name Booking.com). We act as an intermediate between hotels and users in order to provide our users with the possibility to search and book hotel accommodation online. Our service is based on information provided by hotels. Although we do our utmost best to ensure that all information provided on this website is accurate, we cannot guarantee that all information is comprehensive and error-free nor can we be held responsible for interruptions or non-delivery of information.
- The prices on our site are very competitive. All of our prices are the room prices for your whole stay - if not mentioned differently. We also show the highest price for a room to compare it with, which is given by the specific hotel on our webpage for the following months (crossed out values). These are neither rack rates nor competitors rates. Please check the room details to see what is included in the price and what is not.
Privacy
- Booking.com uses high ethical standards and respects your privacy. We will not give your personal information to third parties under any circumstances. Please have a look at our privacy policy for further information.
Credit card guarantee
- Hotels require credit card details in order to guarantee your reservation. Your credit card information will be sent directly to the reserved hotel. When you make a booking you will automatically enter into an agreement with the hotel you have chosen. We will not charge your credit card, as you will pay for your stay at the hotel.
- Be assured that we take our responsibility regarding your credit card information very seriously. We use the industry standard "Secure Socket Layer (SSL)" technology to encrypt your credit card details. Therefore we can guarantee that every transaction made is 100% safe and we will reimburse the first 50 euro should your credit card be misused or abused due to Booking.com. The credit card company is obliged to pay the remainder.
Free of charge
- Our service is free of charge. Unlike many other parties, Booking.com will not add any additional fees, like a reservation fee, to the room rate.
Cancellation
- Please follow the instructions in the confirmation email in case you need to cancel your stay. If you cancel according to the cancellation policy of the hotel, it will be free of charge. We recommend you read the cancellation policy of the hotel carefully. If you cancel later than requested by the hotel or do not show up, the hotel might charge you a fee which is in most cases an equivalent for 1 night stay. Note, Booking.com will not charge you any cancellation fee whatsoever.

Hotel reservation agreements for Orbis base objects (of the OrbisOnLine System)
Definitions
- OrbisOnLine System (hereinafter referred to as the System)
- The Hotel Reservation System via the Internet, which enables reservation of hotel rooms in ORBIS S.A. hotels.
- Client
- A natural or legal person having full capacity to perform acts in law as defined by the Polish Civil Code or other person with no legal personality which can, by virtue of legal regulations, assume rights and obligations, and which uses the System for the purpose of reserving a hotel room.
- Hotel
- A hotel constituting a part of the business operating under the marketing name of Orbis Hotel Group.
- Hotel room services
- Sale of hotel rooms
- Registration Form
- Document of a standard form, in an electronic version used for the purpose of registration of a new Client in the System.
- Reservation Form
- Document of a standard form, in an electronic version used for the purposes of the reservation of a hotel room in the System.
- Cancellation/Reservation Change Form
- Document of a standard form, in an electronic version used for the purposes of the cancellation or modifying the reservation of a hotel room in the System.
- Hotel night
- Starts at 2.00 p.m. and ends at 12.00 a.m. of the following day.
- On Request Reservation
- Reservation of a hotel room by sending an inquiry to the hotel about a possibility to make a reservation for a specified number of rooms.
- On-Line Reservation
- Reservation of a hotel room made on-line via Web reservation systems.
- Guaranteed reservation
- A reservation that remains valid until the end of the first reserved hotel night.
- Non-guaranteed reservation
- A reservation that remains valid until 6.00 p.m. of the scheduled arrival date.
- Cancellation
- Information about resignation from a reserved room sent to the hotel by means of a cancellation form or notified by phone directly to the hotel.
- Terms and conditions of cancellation
- Terms and conditions that must be satisfied in order to avoid being charged extra costs related to the cancellation of a reserved hotel room.
- No show
- Unused hotel night (Client's no show at the hotel)
- System Operator
- ORBIS S.A. with corporate seat in Warsaw, at 16 Bracka street is the System Operator (referred to as the Operator).
Registration in the System
- Clients must register in order to use the System.
- Registration does not mean that the user has to use the System or make a reservation.
- In order to register in the System, the user must fill-in the form.
- Registered users of the System have a ready access to their reservations (Your Reservations option).
- Registered users of the System shall protect their password and access code and shall undertake to refrain from any action leading towards breaking the passwords of other users and from using the System to track data transmitted by other users without due authorization.
Reservation
- Reservation in the System is made by filling-in and sending the reservation form.
- The Clients shall bear full liability for the consequences of quoting incorrect particulars in the form.
- The hotel shall not bear responsibility for lack of access to the Reservation System for reasons beyond the hotel's control, for security reasons or for any other reasons beyond the hotel's control.
- The Operator shall have the right to temporarily suspend access to the System for a period necessary to remove existing threats or irregularities.
- All reservations made though the System are guaranteed. This entails that the Client must make a prepayment by a bank transfer (applies only to reservations made not later than 3 days prior to the scheduled arrival date) or to quote particulars of the Client?s credit card. Non-guaranteed reservations may be made exclusively in the case of Standard Rate and Rate of the Day. This entails that in such a case the Client pays for the entire stay after arrival at the hotel. No amount is charged to the Client as a guarantee at the time of reservation.
Please note: For non-guaranteed reservations, in case of high hotel occupancy, the hotel may request the client who made an on-line reservation to make a deposit payment.
Form and conditions of payment
- CREDIT CARD
- The payment is authorized and processed via the terminal at the System site linked directly to the server of the Polcard site by means of 128-byte encrypted protocol.
- The amount due for the first night is blocked on the credit card and is then charged within 7 days from the date of the reservation. In the case of reservations made less than 3 days prior to the scheduled arrival date, the amount due for the first night shall be automatically debited from the credit card.
- If the amount due for the first night is blocked on the credit card on the account of the reservation on dates specified above, the reservation shall be deemed invalid.
- The Client must settle the payment for services not included in the reservation (such as additional nights, pay TV or mini-bar) at the hotel.
- PREPAYMENT BY BANK TRANSFER
- If the room rate is quoted in EUR, the amount to be paid in PLN must be calculated on the basis of the average rate of exchange published by the National Bank of Poland (NBP) on the date of payment. The final settlement of payment takes place in PLN according to the average rate of exchange published by the NBP on the date of arrival in the hotel.
The Client must send the confirmation of prepayment to the fax number specified on the reservation confirmation or by e-mail within 48 hours from the receipt of reservation confirmation. If case the hotel does not receive the prepayment confirmation or the relevant amount is not credited to the hotel's account 48 hours after the Client made the reservation, such reservation may be cancelled by the hotel.
- VAT Invoice
- The hotel shall confirm the receipt of the prepayment and provision of service by issuing, at the request of the Client, of a VAT invoice in accordance with the applicable provisions of the tax law.
Confirmation
- The System offers hotel rooms subject to automatic confirmation (on-line reservations) as well as reservations that must be confirmed by the hotel (reservations on request).
- In case of reservations on request, confirmation is sent by the hotel to an e-mail address specified by the Client in the form within not more than 24 hours.
The confirmation quotes the reservation number or notifies the customer of non-availability of rooms on a specified date. Upon receipt of the confirmation, the reservation shall be considered as valid.
Scope of responsibility
In the event of Force Majeure beyond the control of any of the parties, such as natural disaster, strike, outbreak of war or other extraordinary events preventing the provision of services as stipulated in the agreement, the hotel reserves the right not to fulfill its obligations.
Terms and conditions of cancellations
Terms and conditions of canceling the reservation are dependant upon the type of the rate payable by the Client. Hence:
- Standard rate / Today's Special (Sofitel, Novotel, Mercure and Orbis Hotels)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
In case of a guaranteed reservation:
If a reservation is not cancelled by 6.00 p.m. on the scheduled day of arrival or in case of a no-show, there shall be a charge for the costs of the first unused night (regardless of the duration of stay for which the reservation has been made).
In the event a reservation is cancelled by 6.00 p.m. on the scheduled day of arrival, the hotel shall refund the amount charged as a reservation guarantee to the bank account indicated by the Client, or shall credit the credit card.
- Standard rate, weekend promotion, Vitabis rate, Vitastudent rate, Easter Offer, May offer (Ibis, Etap)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
If a reservation is not cancelled by 7.00 p.m. on the scheduled day of arrival or in case of a no-show, there shall be a charge for the costs of the first unused night (regardless of the duration of stay for which the reservation has been made).
In the event a reservation is cancelled by 7.00 p.m. on the scheduled day of arrival, the hotel shall refund the amount charged as a reservation guarantee to the bank account indicated by the Client, or shall credit the credit card.
Note: Vitabis rates are intended only for sportspersons holding a valid federation or sports club membership card and an invitation to participate in a sports event. Upon arrival at the hotel, the guest is asked to present a valid federation or sports club membership card and an invitation for an event as well as the confirmation of reservation at the reception desk. In case of the guests' failure to present the above documents, the hotel shall have the right to charge a standard rate for the stay. More information on the Vitabis promotion on www.orbis.pl.
Note: Students are eligible to take advantage of this offer on the basis of a valid student's card.
If a client making a reservation at a Vitabis or Vitastudent rate will be unable to present documents evidencing that such client is entitled to avail of such rate, the hotel will charge its standard rate.
- Promotion (Novotel, Mercure, Orbis Hotels)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
If a reservation is cancelled within less than 72 hours before the beginning of hotel day on the date of scheduled arrival or in the event of a no-show, the Client shall be charged with the costs of the first unused night (regardless of the duration of stay, for which the reservation has been made).
If a reservation is cancelled 72 hours or more before the beginning of hotel day on the date of scheduled arrival, the hotel shall refund the amount charged as a reservation guarantee to the bank account indicated by the Client or shall credit the credit card.
- Promotion (Sofitel and Hotel Orbis Francuski Krakow)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
If a reservation is cancelled within less than 24 hours before the beginning of hotel day on the date of scheduled arrival or in the event of a no-show, the Client shall be charged with the costs of the first unused night (regardless of the duration of stay, for which the reservation has been made).
If a reservation is cancelled 24 hours or more before the beginning of hotel day on the date of scheduled arrival, the hotel shall refund the amount charged as a reservation guarantee to the bank account indicated by the Client or shall credit the credit card.
- Promotion with breakfast (Sofitel)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
If a reservation is cancelled within less than 24 hours before the beginning of hotel day on the date of scheduled arrival or in the event of a no-show, the Client shall be charged with the costs of the first unused night (regardless of the duration of stay, for which the reservation has been made).
If a reservation is cancelled 24 hours or more before the beginning of hotel day on the date of scheduled arrival, the hotel shall refund the amount charged as a reservation guarantee to the bank account indicated by the Client or shall credit the credit card.
- Sofitel Getaway (Sofitel)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
If a reservation is cancelled within less than 72 hours before the beginning of hotel day on the date of scheduled arrival or in the event of a no-show, the Client shall be charged with the costs of the first unused night (regardless of the duration of stay, for which the reservation has been made).
If a reservation is cancelled 72 hours or more before the beginning of hotel day on the date of scheduled arrival, the hotel shall refund the amount charged as a reservation guarantee to the bank account indicated by the Client or shall credit the credit card.
- Hot Deals, Early Breaks, City Breaks (Sofitel, Novotel, Mercure, Orbis Hotels)
At the time of reservation, the Client shall be charged with the costs of the entire stay. In case the reservation is changed or cancelled, the amount of the guarantee shall not be refunded.
- Pascal rate / MasterCard / Radość Życia (Sofitel, Novotel, Mercure, Orbis Hotels)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
In case of a guaranteed reservation: If a reservation is not cancelled by 6.00 p.m. on the scheduled day of arrival or in case of a no-show, there shall be a charge for the costs of the first unused night (regardless of the duration of stay for which the reservation has been made).
In the event a reservation is cancelled by 6.00 p.m. on the scheduled day of arrival, the hotel shall refund the amount charged as a reservation guarantee to the bank account indicated by the Client, or shall credit the credit card.
- Orbis Gold Club (Sofitel, Novotel, Mercure, Orbis Hotels, Ibis)
Reservations may be cancelled on the basis of a cancellation form in the OrbisOnLine System or directly at the hotel, by way of quoting the reservation number.
Personal data
- Orbis S.A. shall be the administrator (Operator) of the personal data. According to the Act on Protection of Personal Data, personal data is stored and processed by the Operator subject to the necessary security safeguards, as required by the Polish law.
- Clients using the System grant their consent for processing by the Operator of the personal data provided by them to the extent necessary to render the services offered by the System.
- At any time after the registration, Clients may review and alter their personal data registered in the System or delete it from the System.
Acceptance of the Terms and Conditions of Web Reservations
- Reservation on-line
- By clicking on the button "I AGREE" in RESERVATION, STEP 2/2, the Client shall be deemed to have understood and accepted the terms and conditions of these Rules.
- Reservation on-request
- By clicking on the button "SEND" the Client shall be deemed to have understood and accepted the terms and conditions of these Rules.
